TalentTuner Intellectual Property Rights Policy

1. Introduction

This Intellectual Property Rights Policy ("IP Policy") clarifies the ownership, usage rights, and protections related to content created, submitted, and generated while using TalentTuner. This policy supplements our Terms of Service and provides specific guidance on intellectual property matters.

TalentTuner is an unincorporated resume optimization platform operated by an individual owner based in Toronto, Canada. Our platform uses both proprietary algorithms and AI technologies to analyze resumes and provide optimization suggestions.

2. Definitions

For the purposes of this policy, the following terms have these specific meanings:

  • "User Content" refers to any content you upload or input into TalentTuner, including but not limited to resumes, job descriptions, profile information, and feedback.

  • "Generated Content" refers to content created by TalentTuner through our algorithms and AI systems, including match scores, keyword analyses, improvement suggestions, action plans, and optimization recommendations.

  • "TalentTuner Content" refers to all content created by or owned by TalentTuner, including our website design, interface elements, graphics, logos, programming code, algorithms, and marketing materials.

  • "Intellectual Property Rights" refers to all rights in and to intellectual property, including patents, copyright, trademarks, trade secrets, and other proprietary rights.

3. Your Intellectual Property Rights

3.1 Ownership of User Content

You retain all ownership rights to User Content you submit to TalentTuner. This includes:

  • Your resume text, formatting, and design
  • Job descriptions you input
  • Profile information you provide
  • Feedback you submit

3.2 License to TalentTuner

By submitting User Content to TalentTuner, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Use, reproduce, modify, and process your User Content to provide the Service
  • Store your User Content on our servers (Firebase)
  • Transmit portions of your User Content to our AI providers (OpenAI) for analysis
  • Create derivative works based on your User Content in the form of analysis results
  • Use anonymized data derived from your User Content to improve our algorithms
  • Maintain backup copies of your User Content for security and recovery purposes

This license exists solely for the purposes of providing and improving the TalentTuner service. We will not use your User Content for any other commercial purposes without your explicit consent.

3.3 Third-Party Content

If your User Content contains third-party intellectual property (such as company logos, trademarked terms, or copyrighted content), you represent that you have the necessary rights to include this content in your submissions to TalentTuner.

4. TalentTuner's Intellectual Property Rights

4.1 Platform Content and Technology

TalentTuner retains all rights, title, and interest in and to:

  • Our website design, user interface, and visual elements
  • Our logo, branding, and marketing materials
  • Our proprietary algorithms and methodologies for resume analysis
  • Our codebase, including frontend and backend software
  • The structure, organization, and appearance of our database
  • Our match score calculation methodology
  • The feature gating system that differentiates access tiers
  • Our documentation and support materials

You agree not to copy, modify, create derivative works from, reverse engineer, decompile, or otherwise attempt to extract the source code or algorithms of TalentTuner without explicit written permission.

4.2 Generated Content Ownership and License

The intellectual property rights to Generated Content produced by TalentTuner (such as analysis results, match scores, and improvement suggestions) are owned by TalentTuner. However, we grant you a personal, worldwide, royalty-free, non-exclusive license to:

  • View and access the Generated Content while using TalentTuner
  • Download, save, and print Generated Content for your personal use
  • Implement recommendations and suggestions in your own resume
  • Share your analysis results with potential employers or career advisors
  • Incorporate suggestions into your professional materials

This license is conditional upon your compliance with the Terms of Service and appropriate subscription status (Free or Premium tier). Your license to use Generated Content remains valid even after you cancel your subscription, for any analyses created during your active subscription period.

4.3 Limitations on Generated Content Usage

The license to use Generated Content does not include the right to:

  • Commercially resell or redistribute TalentTuner's analysis results
  • Create a competing service using TalentTuner's methodology or outputs
  • Share your account access to allow others to receive Generated Content without their own accounts
  • Scrape, extract, or automatically collect Generated Content
  • Remove TalentTuner branding or attribution from Generated Content
  • Use Generated Content to train third-party AI systems

5. AI-Generated Content Considerations

5.1 AI Technology in TalentTuner

TalentTuner uses a hybrid approach that includes:

  • Proprietary algorithms developed specifically for resume optimization
  • Integration with OpenAI's API for natural language processing
  • Custom proprietary scoring and analysis technologies

5.2 AI Output Ownership

The suggestions, analyses, and recommendations provided by TalentTuner's AI features are:

  • Created specifically for your resume based on your inputs
  • Owned by TalentTuner as Generated Content
  • Licensed to you as described in Section 4.2
  • Not subject to third-party claims by our AI technology providers

5.3 Implementation Rights

You have the right to implement any suggestions provided by TalentTuner's AI features in your own resume and professional materials. Once incorporated into your resume, the resulting content becomes your own, subject to standard copyright principles.

6. Trademark Policy

6.1 TalentTuner Trademarks

The TalentTuner name, logo, and any other TalentTuner trademarks, service marks, product names, and feature names are trademarks of TalentTuner. You agree not to display or use these trademarks in any manner without prior written permission.

6.2 Fair Use

Limited references to TalentTuner as a service you use (e.g., "I optimized my resume using TalentTuner") are permitted under fair use principles, provided they do not imply sponsorship, endorsement, or affiliation.

6.3 Third-Party Trademarks

Any third-party trademarks appearing on TalentTuner are the property of their respective owners. Their presence on our platform does not imply any affiliation with or endorsement by these companies.

7. Copyright Infringement and DMCA Policy

7.1 Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement on TalentTuner, please send a notice containing:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work you claim has been infringed
  3. Identification of the allegedly infringing material on TalentTuner
  4. Your contact information (address, telephone number, email)
  5. A statement that you have a good faith belief that the use is not authorized
  6. A statement, under penalty of perjury, that the information in your notice is accurate

7.2 Counter-Notification

If material you uploaded has been removed due to a DMCA notice, you may submit a counter-notification if you believe the removal was a mistake or misidentification. Counter-notifications must include:

  1. Your physical or electronic signature
  2. Identification of the material removed and its previous location
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  4. Your name, address, and telephone number
  5. Your consent to local federal court jurisdiction

7.3 Repeat Infringer Policy

TalentTuner maintains a policy of terminating accounts of users who repeatedly infringe the intellectual property rights of others.

8. User Feedback and Contributions

8.1 Feedback License

If you provide feedback, suggestions, or ideas about TalentTuner ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute that Feedback for any purpose, including improving TalentTuner and developing new features.

8.2 No Obligation to Compensate

TalentTuner is under no obligation to provide compensation for Feedback, and you provide Feedback voluntarily and without expectation of payment or ownership in any improvements to TalentTuner that might result from your Feedback.

8.3 No Obligation to Implement

TalentTuner is under no obligation to implement any Feedback received from users, regardless of the perceived value or importance of such Feedback.

9. Termination Effects on Intellectual Property

9.1 Upon Account Closure

If you close your TalentTuner account or your account is terminated:

  • Your license to use TalentTuner Content immediately terminates
  • Your license to use previously generated analyses remains valid for personal use only
  • Our license to use your User Content will terminate, except for:
  • Anonymized or aggregated data that cannot identify you
  • Backup copies maintained for legal compliance
  • Information required for record-keeping purposes

9.2 Data Retention and Processing After Account Closure

Upon account closure:

  • We will remove your personal identifiers from your data within 30 days
  • We will retain anonymized and de-identified versions of your resume data, job descriptions, and analysis results indefinitely
  • This retained data will be used for:
  • Improving our algorithms and match scoring accuracy
  • Enhancing keyword recognition capabilities
  • Training our systems to better understand resume optimization
  • Analyzing trends in resume content and job market requirements
  • Service and feature development

This retained data will be processed in a way that prevents re-identification of individual users. By using TalentTuner, you acknowledge and agree to this ongoing use of anonymized data even after account closure, as this is essential to our service improvement and development.

10. Dispute Resolution for Intellectual Property Claims

Any disputes regarding intellectual property on TalentTuner will be resolved according to the dispute resolution procedures outlined in our Terms of Service.

11. Changes to this Policy

TalentTuner reserves the right to modify this IP Policy at any time. We will provide notice of significant changes by posting the updated policy on our website and updating the "Effective Date" at the top. Your continued use of TalentTuner after such modifications constitutes your acceptance of the revised policy.
